19/06/2024 at 1:13 pm #110002Important note: Some of the information I posted a couple of days ago is not accurate. There was no direct link to ICP. The cold call came from Gravaman Consultants Ltd who, it seems, have associated lawyers. A conversation today indicated that they only take on cases that are guaranteed to terminate Anfi ownership.
Does anyone have, or had, dealings with this company? I need to know if they are genuine, and successful in terminating contracts. Although I have not received maintenance invoices for the past two years having, theoretically, handed my weeks back, I no longer know if I still own the weeks. Receiving a large bill for years of back maintenance would be a disaster.

When Brian, our webmaster, visited Anfi a few weeks ago he made a real effort to encourage responses as well as to inform. He posted items of interest almost every day but this appears not to have prompted the response he had hoped for, if any.

19/03/2018 at 12:29 pm #22761For many years we owned three floating weeks in Monte but two years ago handed back two of these at no cost to Anfi whatsoever. We retained the third week, primarily for me to remain as the treasurer of our club until a new one could be found. This will probably turn out to be an expensive decision given that the recent court rulings indicate the gradual reduction to the amount being received.
In our case the first instance court have ruled that our pre 1999 contract was declared as being null and void but made no award whatsoever. This is very unsatisfactory and an appeal will be made by JCLA.
There may not be many cases relating to a pre 1999 contract but as you will have read in the recent email sent to club members, from JLCA, one appeal against this ruling has been successful with an award being made. We are just hoping that any award will cover our legal and other costs.
We are not holding our joint breaths!

If your hearing was 1 Feb this year then you have been served very quickly. Our pretrial hearing was on 4 October and we have not yet received a ruling. There are obvious time scale difference between the courts and most are aware of this..
12/11/2017 at 3:09 pm #17617It is difficult to believe that about a month ago we sat on the steps of the original building having walked back from Puerto Rica “over the top”. Would have been good to have been able to stop for refreshment before moving on to Patavalaca.

After a 4 year break we went to Valentino 3 times and each time had good quality food and an excellent service. It was rewarding to find that this restaurant had maintained it’s good standard over the years.

Our hearing was on Monday the 9th October (This morning)
We received notification from JLCA of the court times and the time that we would be met by the lawyer representing us; there are only two in Gran Canaria. The email included a Google map of the court location and the full address. The meeting place is on the ground floor of the court “Juzgados”.
The court No 1, along with other courts, is a white (ish) rectangular building a few hundred meters from the GC500. It can be seen from the road whichever of the two parallel roads you approach. A good landmark is Holiday World which is more or less next door (an Amusement park). The bus stop that we arrived at, Cruce el Tablero,,, was at the rear of the building so it was a matter of walking down the right hand side of the building and entering the blue framed glass doors in the centre. Our instruction was to meet on the ground floor.
Our appointed time was 10:00 with the hearing due to start at 10:45. Our lawyer arrived soon after 10:00 and we moved to the 2nd floor into a room where we could have a meeting. Mrs Luisa Olaskoaga went though the questions that we were likely to be asked.
At the appointed time we were shown into a square room with a dais on which were three desks, the center one for the judge and either side desks for the lawyers, set at right angles to that of the judge. There were also a couple of other officials who seemed to be involved with the administration. As we walked in there were seats on either side of the room facing the dias and in front of these and in the centre, two chairs and a microphone. Our lawyer had said that the female judge sometimes decides to ask questions of the female but in our case this was not so, probably because our lawyer may have told the judge that I dealt with the holiday arrangements. Not the case but it worked for us. We hope so anyway! I was called forward to sit in the chair with the microphone and in the chair alongside me sat an interpretor. Andrea remained in one of the seats behind. The defence lawyer representing Anfi sat on the right and ours on the left. I was then asked questions by the Anfi lawyer which generally required a yes or no answer, the majority of which had been covered by our lawyer on the pre hearing meeting. Our lawyer also asked me various questions. There were no more than half a dozen questions and the whole hearing, stage one, took no more than 15 minutes. Everyone had remained seated during the whole process. We all then left the room and waited for another person to arrive. We had the impression that he was the expert who worked through the figures and gave an opinion as to the amount to be awarded, if any, but this could not have been the case as we had to re-enter the court room where this person sat in the seat by the microphone and spent five minutes speaking in Spanish. He then moved back to the seats behind on the right hand side. The lawyers then made a 5 to 10 minutes presentation to the judge, ours first and then the one representing Anfi.
The decision will be expected to take two to three weeks.
We left the building just before midday and caught the bus (001) back to Patalavaca for a pizza and a beer.
Overall the hearing was not too traumatic nor very formal and the only restriction was that Andrea and I should not communicate during the hearing. The judge was a young female and looked bored throughout. Surprisingly, when she took off her gown she was wearing an off the shoulder top. Just shows what a black gown can cover!
We had originally owned a fixed week in Puerto which we bought in 1995 and in 1999 exchanged, at extra cost, of course, floating weeks in Monte so our situation was a little more complex. A question relating to this was “Why did we buy more weeks at Anfi?”

Was it explained to us that failure to pay on time attracted an 18% interest charge?
Why were we making a claim against Anfi?
Did we receive additional documents to follow up the original ones supplied when we made the purchase?
There were a few other questions but most of these will be covered in the pre hearing brief.
Passports are also required and taken from you.

We are attending court tomorrow morning (Monday). The lawyer is meeting us there 45 minutes prior to the hearing.
We also decided to make a week’s holiday of it and are staying in Patavalaca. Carried out a recce for the bus stop location which was just as well as we missed it and had to catch a bus back. The court (No 1) is very near to the GC500 and the bus stop close by. Cruce el Tablero is the name of the bus stop and it is very close to Holiday World

01/10/2017 at 7:27 pm #16375There is no doubt the the new structure is much improved as the forum groups make selection a very logical and simple process. Any forum selected also leads to a list of all recent replies and scrolling down shows a list of recent post against individual topics. To quickly select another forum scroll up the list to “Forums – main section”.
Although not strictly a forum the newly configured “Online News & Announcements” now looks like many website presentations that provide enough information to filter the topics that an individual members can read more or ignore altogether. Each item is dated and helps to identify those that one has not yet read.

Most of our members making a claim are using JLCA, based in Spain. I suggest that you go to our Club Forum then search for “Claims”. Here you will find a mass of information going back several months.

05/07/2017 at 6:19 pm #13622When we purchased in 1999 Monte was affiliated to II but my understanding was that this ceased several years ago and went to RCI. It is very likely that this has changed again. Perhaps both companies are now involved in some form.

11/06/2017 at 6:07 pm #12575Wolfgang has made a valid point and a solution will be difficult to find. I am a member making a claim but would not wish to see the enjoyment of the majority of members harmed. Anfi could have solved this in two ways, a) by treating owners in the same way regardless of the party they purchased from, resulting in floating weeks that have little or no resale value or b) by offering to buy back weeks at a reasonable price.
As I see it, this would still be a valid option. The weeks would be sold on and Anfi would still make a good profit.

21/04/2017 at 9:33 pm #10307I do have some empathy with you in this matter Phil but from time to time we should perhaps remind ourselves that our club provides the means for us to communicate with each other. It cannot nor should not dictate the nature of this communication, within reasonable boundaries of course, in the hope that the majority of members give and gain something to improve the enjoyment of Anfi. We all know that it is never that simple as there will always be the few that give and many more that will take as with almost any volunteer organisations. My point here is that without the few already making the effort to add information or to pass on advice and experiences running a website at all becomes a fruitless operation.
You seem be taking the sensible option in avoiding the forums in which you have no current interest.

If you scroll down to the bottom or hit the keyboard End key to get to the last post then work backward by scrolling up or using the Page up key you can be kept busy reading for quite a long time.

There are two ways in which the last items can be viewed quickly.
a) Click on My Club then wait for the drop down menu to clear then look down on the right hand side and below My Adverts you will see “Latest forum Activity”. Click on this and when the list appears click on the text showing the age of the post in the right hand column. The most recent post will appear. You with be presented with ‘Reply to’ box and just above it will be the latest post.
b) Click on My Club then the appropriate forum. If using a standard keyboard hit the End key to reach the end of the list and then use the Page Up key to move back up until you reach the last item posted.
I have not found a quicker way of doing this at the moment with this standard forum but someone might have the answer if it exists.
