Our case was heard on 27th November 2017 in Court Number 1.

Based on what others have experienced in other courts we didn’t expect to have a decision for weeks if not months but we actually heard from JLCA today regarding the outcome.

The judge decided (on 1st December I think) that our contract was null and void so that’s the first step to seeing some monies back.

Perhaps the apparent logjam at the Courts is finally clearing.

As expected given recent changes we were not awarded the refund of maintenance fees nor costs.

But we have been awarded refund of the purchase price plus double the deposit (it was paid on the day) plus what looks to be loan interest (we took out an Anfi loan) less an amount for use of the weeks over the years based on the published formula.

Hi. Flew recently to GC with Jet2 and returned with Aer Lingus (due to Monarch going bust) both with hand luggage only.

I flew out of Machester last Saturday (25/11) with Jet2 hand luggage only with online checkin. You still have to go through Security as normal of course so have to have the separate clear bag for fluids of less then 100ml. But Jet2 didn’t weigh my case or check the size of it, even when as a first time user of online checkin I went to the Jet2 checkin area in case they wanted to weigh the bag or put in the size checker. They didn’t.

With Aer Lingus (not booked direct but via Kiwi) I couldn’t do online checkin and the lady on the checkin desk at Las Palmas asked me to put the bag on the scales and in the size guide.

I checked on TripAdvisor and Booking.com and various sites before travelling and only recall one airline (don’t think it was Tui) weighing hand luggage at the gate.

On all 3 flights ( I had to come back via Dublin) I was offered to have the carry-on case go in the hold for free and all the cabin crew announcements stressed only using the overhead lockers for cases and mot other bags.

Might be worth asking Tui especially if their carry-on allowance is only 5KG, most cases weigh 1.5 to 2 kgs so as you say that doesn’t offer much to pack.

    Hope that helps.

    Terry

Our case was heard on Monday this week (27/11/17), everyone’s case is slightly different I expect so I hope this is of some help to anyone yet to attend court.

Our original hearing date was in April but I couldn’t attend for work reasons and after providing a letter confirming why to JLCA the judge rescheduled to July. In the interim my other half became very ill and was in hospital for half of June and remains unable to fly for several medical reasons. After providing a letter from our GP the judge rescheduled to 27/11/17, the longer deferment with a view to allowing her to recover I believe.

She still can’t fly so I travelled solo and stayed in Meloneras for  the Saturday and Sunday nights, the apartment was about 6 or 7 mins away in a taxi.

The court experience was very similar to as others have described.

There is airport-style security as you enter. I had my carry-on case with me because I was going to the airport straight from the Court and I was allowed to take it into the hearing. All 5 courts are in the same building, I was in Court Number 1.

Koldo the JLCA lawyer met me in the court lobby on the ground floor at 11:45, our hearing was at 12:45. NB Her picture on the JLCA website has her with blonde hair but she had dark hair on Monday. In an upstairs room she ran through the likely questions and responses and then we went to the hearing.

A chap in jeans and a t-shirt opened the courtroom and took my passport and started the AV equipment. The layout was exactly as Emrys’ excellent description.

The judge was given the original of the most recent letter from our GP confirming why Sharron couldn’t safely fly and it was passed to the Anfi team for them to check, to be met with shrugs and acceptance. I suspect that they hoped to use her absence to delay the hearing for as long as possible but that wasn’t to be.

I was asked 10 questions in total all via the translator with just a couple of the questions from Koldo.

I expected to be asked why we had brought the claim but wasn’t. I also expected to be asked if we had started the claim because Sharron was unable to fly but wasn’t.

The so-called expert on hotel prices was then asked one question by the Anfi lawyer which he answered very briefly and he then left.

After the hearing I had a debrief with Koldo and she said that she was very happy with my answers hence had only asked a couple of questions to bring up points that Anfi had deliberately not done as they did not suit their position. She said it had gone very well.

Based on what others have said and the lack of speed with which things progress through the local courts I know we may not get to know the outcome of this stage for a few months at least.

Thanks for the update Julie, we received the email from JLCA yesterday.

Our hearing was held on Monday (27/11/17) and I was surprised by how quickly it was over (35 mins).  The so-called expert on hotel prices was in attendance but he was only asked one question which the Anfi-provided translator didn’t translate for me but which he answered in very few words. The lack of much involvement by the so-called expert now makes sense given the Spanish Supreme Court decision about maintenance fees.
