    Our website developer has been looking at the problem with “missing menus” which affects some members,   but so far we have had real trouble trying to replicate the issue –  one of our members has offered to do a screenshare that might help the developer

    [I have read some of the post but I am still confused as to whether we should sign the contract and what happens if we don’t. ]
    – Anfi seem to be getting more difficult with pushing people to sign, suggesting they can sign or sell  –  hard to be sure how awkward they will make things.
    – if you sign as well as losing right to sue Anfi, Anfi have first right of refusal if you do sell.  Though the contract does formalise your right to hand back the week to Anfi with no future obligation.

    [Do we need to sign it in order to rent our week out? by signing the contract does this also remove the in perpetuity?]
    – you shouldn’t have to but Anfi have put pressure on some members to sign before they will issue a guest cert –  we discussed on the members call on the 29th Nov & resale members are not under pressure yet direct purchase members have had pushback from Anfi about signing.

    Hi Lesley

    By “recover the week” I think what Anfi are saying is they will give you a voucher for your 2020 week that you didn’t use, if you sign new contract.  Maybe best to ask Anfi to confirm that.

    With your 2021 week Anfi have offered compensation & details are in with the 2022 invoices –  extract below but please read the invoice attachment to get full details – if you haven’t got that I can send you what I have just let me know (the attachments are with invoices on the anfi.com members area & when you log in, under Collections)

    Your options are for your week 52:-

    – try to rent out the week
    – or just leave it (though read below and check what “name on arrival list” means – we read that as if you have fixed week, you are on arrivals list.
    – if you don’t rent or don’t turn up, then Anfi offer compensation as either a voucher or a discount off the 2022 fee

    Don’t leave paying your 2021 fee until after the 2022 one becomes due as once you have missed two maintenance payments Anfi can reclaim the week.

    Roger has commented on another thread that suggest members take the discount off the 2022 fee rather than the voucher, as that gives you definite £ now
    If you could rent your week 52 then you may be better off financially if you can get a quick rental and ensure all rental paid to you promptly.
    The voucher is for another week  but do read limitations on booking periods and validity.

    Arrivals between week 40 to 52/2021: If, from week 40 to 52 of the 2021 timeshare calendar, your name is on the arrival list of members to check into the club, but you do NOT arrive for whatever reason, you do not send guests or rent out your week and you do not deposit your weeks with AVC, RCI or II, you should be due compensation on your 2022 maintenance fee invoice. However, as the invoices have already been produced and uploaded onto the Anfi system prior to week 40, you will see that compensation has not been included in your invoice, because at the time of producing the invoices Anfi did not know if you were going to arrive or not. If you do not arrive or use your reservation, Anfi will contact you via email after your scheduled arrival date to confirm your eligibility to compensation.

    Example: If you are scheduled to arrive on 4th December 2021 and your name is on our arrival list of members to check in on that day but you do not arrive, you will be contacted by Anfi after 4th December to confirm your eligibility for compensation, and to confirm that the compensation has been applied and that a new 2022 maintenance fee invoice has been issued and is available to be paid.

    Conditions for using accommodation vouchers:
    The accommodation vouchers can be reserved 10 months in advance of your proposed arrival date and are subject to availability. These vouchers can be used to reserve accommodation in the following periods (of the timeshare calendar):
    In 2023:
    – weeks 16 to 25, weeks 34 to 39 and weeks 48 to 49
    In 2024:
    – any time of the year from week 15 onwards

    Puerto Anfi Election Results – great news for the clubs nominee Geoff Mathews who has been successfully elected onto the Puerto Anfi committee (see details below). We wish Geoff every success over the next 3 years along with Ruth from Club Germany and Lise from the Norwegian Club.

    It is unfortunate that so many invalid ballots were received and we hope Anfi will take action to make it as easy as possible for members to vote correctly, by clarifying instructions and/or amending the voting form.

    Hello David

    I’ve flagged your question about potential future liability for Anfi debts for the Zoom call this evening

    Whilst we don’t have  a legal view on this my own view is that our timeshare “ownership” is nothing to do with the liabilities of the company, nor is it actually ownership,  hence why you can’t find any mention of this.

    The contracts we have are for use of apartments and refer to rotational enjoyment right – i.e. the right to use our week(s)
    The new contracts also have a clause confirming your right to hand back at any time and only liable for maintenance up to that date.

    To discuss this evening no doubt!

    Hi Brian

    Some members have reported not seeing the points balance.  Mine disappeared last year and only reappeared recently, though I still can’t see them on the Anfi app. Only the website.   When logged into the members area I can see the two Clubs that are linked to my contract and always have been able to, even when no points.

    We know that when Anfi issue a new contract the account is frozen and points can’t be seen – this applied to me for a few months but not most of the year.

    A couple of members have commented on our Facebook group about not seeing points balance.

    Can you see your invoices under the Collections section?

    I’ll check with Roger and Richard though pretty sure this has been raised with Anfi before.

    also is your 2 bed a 2 bat or 1 bath –   2 bath are rarer and hence higher rental or resale value

    Hi Graham
    Just adding to David’s reply
    [and for all of this, things may change by Jan so keep checking gov.uk advice and the hellocanary’s website]
    – Anfi no longer ask for your covid status (this changed mid October) – however it is checked as you fill in the Spanish form and they check, or spot check, at the airport when you arrive

    – you don’t need the Spanish app – at least we were not asked about it when we went out 18th Oct

    – so for Spanish end, as you say, get it all printed out before you go and they will scan paper copies at Las Palmas airport – the form can be started upfront and completed in last 48 hours

    – Anfi just do passport scan when you get there

    – our UK end is a bit more difficult:-

    – if you are taking a laptop with you then you can fill in at Anfi, if not then you could use one of the PC’s near reception, at least near Beach reception – [if you don’t have laptop with you and are unsure about using one of the PC’s near reception, an option is to get you family to do this from home and then they could email you or directly to the Anfi reception and get them to print out for you]

    – firstly, at least for the English passenger locator form, this can only be filled in within the 48 hours before you are due to arrive back home

    – if you still need lateral flow by day 2 nearer to Jan, then as you say book upfront and print off. (I don’t know if Scotland mandate who to use for test – in England I used C-19 Testing which cost £25 per test) and print off the order confirmation as you’ll need the test ref number

    – before you travel back, the England form can only be filled in in the 48 hours before you arrive back, Scotland may differ

    – either you or your family do the form

    – Anfi reception will print off for you – get the email address from reception

    Island President Antonio Morales has now spoken out regarding the problems with health checks at Gran Canaria airport.
    “This island council will not tolerate a repeat of the embarrassing spectacle of endless queues and more than two hours of waiting times, as it took place at the airport over the weekend,” Morales said.
    He calls for immediate action from the state-owned company AENA to prevent hundreds of passengers from being stuck at the airport due to the organizational failure and gathering such crowds.

    The Anfi Group has already informed you all on the measures put into place by the Spanish courts regarding the administration of Anfi Sales S.L. and Anfi Resorts S.L.

    I am writing to you in my capacity as court appointed administrator of Anfi Sales S.L. and Anfi Resorts S.L., to reassure you that the court administration of Anfi Sales S.L. and Anfi Resorts S.L. does not affect the clubs nor your holidays at the resorts.

    All the clubs operate independently having their own income and their own costs. Each club has its own separate Replacement Fund account and its own separate current bank account where you pay your maintenance fees, and which are duly administered to pay for all the services provided to you. These services include all staffing, suppliers, electricity, water, all the external service contractors etc.; in short, everything that is needed for the day to day running of the club to ensure that the resort and apartments are ready for you to continue enjoying your holidays in Anfi.

    Your rights as members to enjoy your holidays and make use of your Anfi membership remain completely unchanged and, therefore, it is particularly important for the club that you continue to pay any finance agreements you may have and continue to pay the maintenance fees into the club account.

    The clubs are managed by Anfi Resorts S.L. but the income and expenses of the clubs is fully independent of the income and expenses of Anfi Resorts S.L., so the administration will not affect the clubs. I have further confirmed the current representatives of Anfi Sales and Anfi Resorts S.L. in the clubs to continue performing their services so that nothing changes.

    I have been informed that the club is currently preparing the maintenance fees for 2022 and, after agreement with the club committee, these will be uploaded on to the Anfi system and be available for payment by early November.

    Dear Members

    RE: Anfi Group

    Continental Trustees Limited is the independent Trustee for the different clubs that comprise Anfi (“the Clubs”) (a schedule of the Clubs where we act as trustee is overleaf).

    As Trustee, we hold legal title to the properties that underpin Anfi’s timeshare Clubs, in order to secure the occupation rights of the members of the Clubs. The properties are held within holding or owning companies, which are wholly owned and controlled by the Trustee pursuant to Deeds of Trust and trust law for you, the Clubs’ members.

    As Trustee, we are independent and have an obligation to you, the members of the Clubs.

    You are no doubt aware that two Anfi Group companies, namely Anfi Sales S.L. and Anfi Resorts S.L. were put into Administration on 20 September 2021. As Trustee, we are of the opinion that the Administration of those two companies will have no effect or impact on the day-to-day management or operation of the Clubs nor on the ability of members to utilise the Clubs’ properties, services and benefits. Recently the court appointed Administrator of those two Anfi Group companies confirmed that the Administration will not affect the operation of the Clubs and that the Clubs’ funds which are held individually by each Club are not classed as assets of the Anfi Group companies but owned and controlled by the relevant Clubs.

    From a member perspective, matters have not changed and your membership and usage of your Clubs and holiday rights remain the same. As members, you should simply continue to make use of these and continue to deal with their management companies in making reservations, paying your annual maintenance fees and any finance agreement obligations you have and most importantly, enjoying your holidays.

    If you have any concerns or queries relating to your membership usage rights or the use of your weeks, you can contact your Club’s Customer Services Department as normal. The Anfi management companies, which service the Clubs, resorts and operations, continue as normal.

    Finally, please note that there is unfortunately some misinformation being distributed on social media and by certain parties. Further, there are some companies which may use the Administration of these two Anfi Group companies to claim that it will affect the operation of the Clubs or your membership rights. This is simply not true. Some of these companies operate to contact members with their unfounded claims for the sole purpose of charging a fee. Please ignore them and if you have any concerns, please feel free to contact your Club’s Customer Services Department for any questions you may have.

    There have been a few posts on our Facebook group about airport delays – though some people have not had any trouble.

    A report on Wednesday in the Daily Express is about delays at the airport last Saturday and Sunday, see link below – when Pam & I came back on Tuesday the airport was fairly quiet, though not many flights in or out around midday.  Also when we went to Anfi on 18th October there was little delay at passport control nor for the medical check.
    In the Express article there is a photo accredited to “John Linda” who, as many members will know, is John Meykel and runs the Anfi Del Mar Facebook group.

    Hi Vincent
    Firstly welcome to the Anfi UK Club – I’ve sent a welcome email out and also the invite for our Facebook group – some members use FB more than this forum so worth posting in both places.

    The Club set up an arrangement with the legal firm JLCA a few years ago with a deal for legal costs – JLCA are not a claims company and are a Spanish legal firm.   Over 100 members are taking legal action.      We can send details, though would point out the claims process has been taking years and not all our members have yet received settlement.
    Also the recent appointment of an Administrator raises question over whether new claims will be allowed for the time being and what will happen with current claims going through the court process.

    With your 3 weeks banked you could try to rent out the weeks and rental adverts are doing quite well now that travel has opened up.  I think you’d need to pay the 2022 maintenance to be able to use the banked weeks though perhaps best to check with Anfi customer services.

    A 2 bed week 48 Monte ought to be a very popular apartment.  You can get an idea of rental prices from our rentals listings.

    In essence your 4 options are

    1 Handback to Anfi – but you get nothing and lose the value of your banked weeks – though do relinquish your week.

    2 Try to sell your week (though Anfi now appear to be insisting new contract signed before they process the sale)  –  I can give an idea of sale prices from our records, though sales have been very slow during the pandemic.

    3 Pursue legal action – JLCA can advise or you could go to another company but do take care as some are not of good reputation.   The legal route takes time, will involve you paying Anfi maintenance for the first stages of the claims route, and the current administration may affect the feasibility of this route at the moment.

    4 Rent out  your banked weeks in 2022 and your fixed week for 2022, whilst you see how circumstances develop.

    I note you don’t want to sign a new contract –  they original concerns on new contracts have been addressed by Anfi and the new contracts are felt to be OK – they fixed week you have is simpler contractually whereas members with floating or points have additional contract docs and complexity.
    Anfi do seem to be upping pressure on people to sign and are emailing some owners giving options of handback / sell / sign – you’ll see other recent posts on forum about this.

    Do ask if follow up queries, and good luck with whichever route you choose.
